1. Seller identification

The website bascour.fr is published by BASCOUR, a simplified joint-stock company (SAS) with a share capital of 1000 €, whose registered office is located at 41 rue Auguste Lançon, 75013 Paris, registered with the Trade and Companies Register of Paris under number 100 663 418.
Address: 41 rue Auguste Lançon, 75013 Paris, France.
Email: contact@bascour.fr
Telephone: +33 7 61 89 14 46
Intra-community VAT number: FR69100663418.

Hereinafter “the Seller”.

2. Scope

These Terms and Conditions of Sale (T&Cs) apply to all orders placed on the website bascour.fr by a consumer customer (“the Customer”). Placing an order implies full and complete acceptance of these T&Cs, which the Customer acknowledges having read before ordering. The Seller may amend these T&Cs at any time; the applicable T&Cs are those in force on the date of the order.

3. Products

The products offered are those presented on the website at the time of browsing, while stocks last. Each product is described with its essential characteristics. Photos are as faithful as possible, but slight differences (for example, colours depending on the screen) may exist. If a product becomes unavailable after the order, the Customer is promptly informed and refunded any sums already paid.

4. Prices

Prices are shown in euros, all taxes included, excluding shipping costs. Shipping costs are shown before the order is confirmed. The Seller may change its prices at any time, but products are invoiced at the price in force when the order is confirmed.

5. Orders

The Customer selects their products, adds them to the cart, enters their shipping and billing details, then accepts the T&Cs. The Customer can check and correct their order before confirming it by clicking the “Place order with obligation to pay” button. The order is final once payment has been made. A confirmation email summarising the order is then sent to the Customer.

The Seller reserves the right to refuse or cancel an order in the event of an existing dispute with the Customer, non-payment or suspected fraud.

6. Payment

Payment is made online, in euros, by the following means: bank card, PayPal, etc. Transactions are secured by Stripe / PayPal. The Seller has no access to the Customer’s bank details. The order is processed once payment has been validated.

7. Delivery

Products are delivered to the address provided by the Customer when ordering, in the following areas: Metropolitan France / Europe / other.

  • Preparation time: 1 to 3 working days.
  • Estimated delivery time: 2 to 5 working days depending on the carrier and the method chosen.
  • Shipping costs: calculated according to weight, destination and delivery method, and displayed before payment.

Shipments are made by our partner carriers (including Mondial Relay), via the Packlink platform. A tracking link is sent to the Customer as soon as the order ships. Delivery times are given as an indication; if delivery exceeds 30 days after the order, the Customer may terminate the contract under the conditions provided by the French Consumer Code.

Upon receipt, the Customer must check the condition of the parcel. In the event of a damaged parcel or missing product, the Customer must express specific reservations to the carrier and contact the Seller at contact@bascour.fr as soon as possible.

8. Right of withdrawal

In accordance with the French Consumer Code, the Customer has 14 days from receipt of the product to withdraw, without having to give a reason or pay any penalty.

To exercise this right, the Customer notifies their decision by email to contact@bascour.fr or by using the standard withdrawal form. The product must then be returned within 14 days of this notification, to the following address: 2 Rue Michelet, 93100 Montreuil, France. Return costs are borne by the Customer.

The product must be returned in its original condition, complete and in its packaging, and the Customer is liable for any depreciation resulting from handling other than that necessary to establish the nature and proper functioning of the product. The Seller refunds the Customer all sums paid (including standard shipping costs) within 14 days of receiving the returned product (or proof of its dispatch), using the same means of payment as for the order.

Exceptions: in accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to personalised products or products made to the Customer’s specifications, to products likely to deteriorate or expire rapidly, and to sealed products which cannot be returned for hygiene reasons once unsealed.

9. Legal guarantees

The Seller is liable for any lack of conformity of the goods with the contract and for hidden defects, under the conditions provided by law.

  • Legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code): the Customer has 2 years from delivery of the goods to take action. The Customer may choose between repair or replacement of the goods, subject to the cost conditions provided by law. The Customer does not have to prove that the defect existed at the time of delivery during the 24 months following delivery (12 months for second-hand goods).
  • Guarantee against hidden defects (Articles 1641 et seq. of the French Civil Code): the Customer may choose between cancellation of the sale or a price reduction.

To invoke these guarantees, the Customer contacts the Seller at contact@bascour.fr. These guarantees apply free of charge to the Customer.

10. Liability

The Seller is responsible for the proper performance of its contractual obligations. It cannot be held liable in the event of force majeure, fault on the part of the Customer, or the unforeseeable and insurmountable act of a third party (strike, transport disruption, etc.).

11. Intellectual property

All content on the website (texts, photographs, logos, graphics, videos, the Bascour brand) is protected by intellectual property law and remains the exclusive property of the Seller. Any reproduction or reuse, in whole or in part, without prior written authorisation is prohibited.

12. Customer account

The Customer may create an account to track their orders. The Customer is responsible for keeping their login details confidential and for any activity carried out from their account.

13. Personal data

The personal data collected is necessary to process orders. Its processing is detailed in the Privacy policy (dedicated tab on this page). In accordance with the GDPR and the French Data Protection Act, the Customer has the right to access, rectify, erase and object, which can be exercised by writing to contact@bascour.fr.

14. Complaints and mediation

For any complaint, the Customer may contact the Seller at contact@bascour.fr. In accordance with Articles L611-1 et seq. of the French Consumer Code, in the event of an unresolved dispute, the Customer may use a consumer mediator free of charge:
[Mediator name, address, website]
The Customer may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr

15. Applicable law and disputes

These T&Cs are governed by French law. In the event of a dispute, and failing an amicable or mediated resolution, the French courts shall have jurisdiction, in compliance with the rules of jurisdiction applicable to consumers.
